Bellefontaine -- The trial of the first of three damage suits against Logan county growing out of the accident in which two men were killed and a third badly 'injured when an automobile went into an open bridge on the Carlisle pike in September Of 1913, was begun Tuesday morning in common pleas court. Lillian Bicher, of Cincinnati, administratrix of the estate of her husband, John E. Bicher, is the plaintiff. She is asking $40,000 damages for the death of her husband. John E. Bicher, George Mantz and David Adams, all of Middletown, O., were en route, in an automobile, from Middletown to Indian Lake Park when early in the morning the automobile plunged into the opening where a bridge had been over Stony Creek, south of Bellefontaine. The bridge had been washed away by a flood and a temporary bridge at the side of the road was being used. Barriers had been erected across the roadway but plaintiffs allege that these were not across the roadway the morning of the accident. There was no warning light there, and plaintiffs will claim that they could not see the danger In the darkness. Bicher was instantly killed In the accident. Mantz was so badly injured that the died a few days later. Adams recovered from his injuries.

Matter of Repairing State Roads Is Submitted.
Columbus, Dec. 23. The supreme court today was asked to decide whether county commissioners are compelled to keep state roads in repair. This request was made by the Logan county commissioners, who asked the court to review a case in which the appellate court of that county allowed Lillian Bicher damages against the commissioners for the death of her husband. Bicher's automobile went over a state road barricade which had replaced a bridge washed away by the March, 1813, flood.

George Mantz also of Middletown was killed in the same accident, and George Adams was injured.
