This indenture made this 18th day of November 1839 between Mary Booher on the one part and Daniel Booher on the other part. Witnesseth that said Mary Booher for and in consideration of the love and affection that she hath and beareth unto her son-in-law the said Daniel Booher hast given granted and confirmed unto the said Daniel Booher and to his heirs forever the following described tracts of land:

The first mentioned tract situated on the County of Sullivan containing one hundred and eighty-five acres be the same more or less. Beginning at a stake on the old line opposite the spring house on the east side of Sinking Creek, thence crossing the creek and through the middle of the large spring S79 W4 poles to a stake at the head of the spring, thence through the middle of the Stillhouse North 3 degrees West 6 poles to a stake, thence North 52 degrees West 4 poles to a cherry tree, thence through the middle of the stable North 30 degrees West 3 poles to a stake, thence South 78 degrees West 87 1/2 poles to a stake, thence North 3 poles to a stake, thence South 51 degrees West 7 poles to a stake, thence through the middle of the barn South 5 degrees E. 6 poles to a stake thence North 82 W 137 poles to a stake in a field, thence passing through the middle of the sugar hollow spring South 67 degrees West 122 poles to a stake on the old line: thence with the same North 7 degrees West 77 poles to a white oak and walnut, thence North 18 poles to a chestnut, thence South 76 degrees East 26 poles to 3 post oaks; thence North 11 East 88 poles to a white oak, thence South 75 degrees East 56 poles to two white oaks and a poplar; thence South 77 degrees East 90 poles to 3 white oaks; thence South 44 degrees East 114 poles to an Elm on the east side of Sinking Creek; thence down the creek with its meanders to the Beginnings.

Also one other 4 acre tract being part of Said old survey Beginning at three white oaks old corner; thence North 7 degrees West 20 poles to a stake; thence South 26 degrees East 33 poles to a hickory, old corner; thence with old line West 31 poles to the Beginning.

Also one other tract of thirty nine acres adjoining the said old tract and beginning at a white oak Ulrich Beelors line; thence South 11 degrees West 88 poles to 3 post oaks; thence North 76 degrees West 70 1/2 poles to three poplars, Jacob Beelers line, thence North 66 poles to an ash and Spanish Oak corner to Ulrich Beelars thence North 86 degrees East 88 poles to the Beginning. Also one other tract of sixteen acres adjoining the old tract and lands of Thomas Rockhold and John Gray.

And I the said Mary Booher for myself, my heirs ___ will warrant and forever defend the several tracts of land above mentioned together with every thing thereunto belonging to the said Daniel Booher and to his heirs forever. But it is expressly understood and agreed that I the said Mary Booher am to have a good and comfortable support from the proceeds of said tracts of land during my life, such as I have been in the habit of receiving, and through any neglect or default of the said Daniel Booher my comfort or happiness should be diminished I hold and reserve to myself the right I have heretofore enjoyed, of leasing or renting said tracts of land for my comfortable support during my life; then said tracts of land with everything thereunto belonging are to be the property of said Daniel Booher his heirs ___ forever warranting and defending against the claim or claims of any person or persons claiming by through or under me. In testimony whereof I the said Mary Booher have hereunto subscribed my name and affixed my seal the day and year first above written.

Source-7 And of Coarse the David buried in Paperville is the son of Martin and Catharine, I also believe but have no definate proof that the father of our Daniel is Christian and Margaret Roth. I also after lots of research through deed and wills that the Mary on the 1850 Census with Daniel and the Children is Daniels Mother in law and the daughter of Martin and Catharine Booher. I only hope I havent confused you too much.. i could be wrong i think these things are never 100% that is why i don't like putting my work on line because i dont want to have stuff out that that people might copy and it possibly be incorrect...but this is what i have down in my genealogy and I have been working on it for over 25 yrs..if anyone finds it inaccurate I would love to know because i would like to correct it. Thanks for the interest not a lot of people are interested and if i can help you any other way let me know Carol

Daniel and his wife were first cousins, she being the daughter of Mary Booher [unmarried], dau. of Martin Booher.
