Salisbury, Aug. 28 -Henry C. Miller, 58, was almost instantly killed about 5:30 o'clock Monday morning four miles west of Salisbury on highway 10 when his car collided head-on with one driven by Dan Yoder.

Mr. Miller, who owns a filling station near the scene of the accident, was taking his son-in-law, Bill Bame, part of the way to Winston-Salem after the latter had spent Sunday with him. Yoder lives near Newton, but works at a hosiery mill at High Point, and was on his way to the latter city. The two cars met on a stretch of road that is almost straight and the impact badly damaged both machines. Bame was thrown clear of the wreck and was apparently only slightly hurt. Mr. Yoder was not seriously hurt and he went to a .Statesville hospital for treatment. Later he was brought to Salisbury and held pending a coroner's inquest.

Mr. Miller was a Spanish-American war veteran and for years was a street car conductor in Salisbury. Lately he has conducted a filling station at Milford Mills. He is survived by his wife and two daughters, Mrs. Bame and Mrs. James E. Beeker, the latter the wife of a Salisbury city letter carrier.

Mrs. Miller and the Beeker family were visiting friends in New Jersey and funeral arrangements await their return.
