Will of John Kehr, 1794

In the Name of God Amen: I John Kehr of Manheim Township in the County of York and State of Pennsylvania farmer, being sick and weak in body but of sound and disposing mind memory and understanding, blessed be almighty God for the same do make and ordain this my last will and testament in manner and form following (that is to say) first I will and order that all just debts and funeral charges shall be paid and satisfyed out of my personal estate, further I give and bequeath unto my dearly beloved wife Mary Kehr before hand of all her bed and bedstead (that is to say) so much bed furniture to make a good bed and my House Clock and case, and my (dask?) and table, and the kitching tressor and the brass kettle and the iron kettle and the brass ladles and skeemer and flash fork and four iron pots her choice and also two pewter dishes and two pewter basons and a half a dozen of pewter plates, and a half a dozen of pewter spoons her choice and also the coffe kettle and tankert, and the coffee mill and six pair of coffee dishes and also the pewter quart tankert and the white quart and her spinning wheel, and the smaller washing tub and her chest and two cows, her cows, and also one of my horse creatures her choice and her saddle and briddle which said articles my said wife shall have before hand of all over and above her equal one third part of my personal estate as hereafter shall be said; further I give and bequeath unto my said wife for the use of the family all the meat that we shall have in the house by the time of my death and from the grain in the barn now, she shall have sixty bushels of wheat and thirty bushels of rye for the use of the family, till next harvest, then from the harvest in the field now my son Christian shall have the equal one half and my wife the other equal one half, and from the grain in the barn now my son Christian is to have the equal one third part thereof for his share of farming the plantation. Further my will is that my said wife have liberty to keep by the appraisement what she chooses wherewith she shall be charged in her thirds; Further my will is and I order that my oldest son Christian shall not be charged with that young mare which he had from me (and already sold) that he shall have for his birthright; further I give and bequeath unto my youngest son Samuel my brown two yearling mare colt in stead of that, that each of my other children have had one horse creature; Further I give and bequeath unto my said wife two other cows her choice for her own use, wherefore she shall then give two cows to my son Samuel when he comes on age and my said wife shall also have to each of the aforesaid four cows a cow chain, Further my will is that all my axes mauls and wedges shall be equally divided between my two sons, further my will is that if my son Christian shall be willing to till and to farm my plantation for the half of the income till my son Samuel shall come to the age of twenty one years he shall have liberty to till and to farm my plantation agreeable to the consent of my wife and to have the half of all the income and my wife to have the other half till my son Samnuel shall be of age as aforesaid, only the orchard is to be divided as follows my son Christian shall have the young orchard for his use and my wife the old orchard for her use and on that case my son Christian shall have liberty to keep by the appraissment my five waggons and plows and harrows and horse gear whereinwith he is to be charged in his shares (the wind mill is to stay by the premisses for the use of the family) further my said wife shall have liberty to keep by the appraissment my brown mare but then my wifs horse creatures shall kept to work the plantation. Further my will is that my two sons shall have liberty to keep by the appraisment my two weaving looms with all the geers thereto belonging, my son Christian shall have the long loome and my son Samuel shall have the short one and the geers to be equally divided between them. Further, I give and bequeath unto my said wife all our linnen things and cloth that we have and all the (?) for the use of the family (wherewith she shall not be charged in her thirds) and my large Bible and the book called marter book she shall have also and then all the residue of my personal estate shall be sold by way of public vendue and my will is that my son Samuel shall be schooled sufficient to keep his own accounts and my apprentice shall have his freedom clothes out of my personal estate according to his indenture. Then my children shall all be made equal in share first, (that is to say) what one or the other should now be advanced they shall first been made even one with the other, then my said wife Mary shall first have one equal third part of the whole of my personal estate according to the meaning aforesaid to hold to her her heirs or assigns for ever, and then the remainder of my personal estate shall be equally divided among my four children, and my will further is that my said wife Mary shall keep and maintain my old mother and that in a soft and christian manner during the time of her natural life, and further my will is that my said wife Mary shall have full right and privledge in my now dwelling house and in the celler and spring and on the lofts for her necessaries without disturbance and also for my old mother during her natural life, and the life of my wife if she remain my widow, and concerning my dwelling plantation situate in Manheim Township aforesaid adjoining the lands of Adam Eichellenger deceased and lands of Samuel Havnisch and others containing one hundred and seventy six acres and a half and the usual allowance ea I give and devise the same with the appurtenances thereunto belonging to my two sons Christian Kehr and Samuel Kehr, to hold to them their heirs and assigns forever in manner following and on the following conditions (to wit) if they can sufficiently secure or make the following payments hereafter mentioned they shall have and hold the place in manner following, my son Christian shall have liberty to live in the old house wherein he now liveth and to have the full use and priviledge thereof and shall also have an equal priviledge in the barn till my son Samuel shall come of age then my wife shall have the outmost stable for her use and my two sons shall have an equal right in farming my plantation as long as they can agree and live in peace only the orchards to be divided in manner aforesaid, and in the articles of maintanance for my wife each of them shall give and allow the equal one half thereof as follows (to wit) if my son Samuel shall once be of the age of twenty years that he has a mind to take possession of the plantation my wife shall have a full right into my plantation to have out and from the same yearly and every year during her widowhood the following articles and things (to wit) twenty bushels of good merchantable wheat fifteen bushels of clean rye and six bushels of indian corn her grain to bought to the mill and the meal home again, fire wood ready cut and delivered to her door as much as she shall have need of as long as my son Samuel shall be under age my son Christian shall help to make the fire wood for my wife but after he being once on age he my son Samuel shall make the fire wood for in his house for he is to live with his mother and all the benches in my dwelling house and all the chairs is to stay in the house, further my wife shall have yearly sixteen pounds of clean hatcheled flax and even so much tow and ten pounds of clean hatcheled hemp and two bushels of fine salt and two hundred pounds of good pork with the fat therein, and all the innards of two hogs to make some puddings and to have the third part of the planting garden yearly tilled and dunged and also one barrel of syder out of each orchard and to chose one roe of apple trees in each orchard to have the fruit thereof. And to have two cows kept in foder stable and pasture as good as their own and to have a quarter of an acre of meadow for grassing for her cows and that where it shall be most convenient for her and shall have a hog stable absented for her use and shall have the fourth part of all the potatoes what they shall plant and turnips as much as she shall want for eating if they get any and to have four sheep kept in foder and pastures as their own and to have two pair of new shoes every year. And concerning the hens that shall be kept on the place my will in that each of my two sons shall find the equal one half of the foder for the hens as long as they live together and then said wife and my two sons shall have an equal right to the hens and to the egs and one horsecreature to be kept for her all those articles is to be given and allowed to my wife yearly and every year during her widowhood and each of my two sons is to find and allow the equal one half thereof and concerning the payments for my plantation my will is that each of my two sons shall pay and give out for his share of the lands the sum of five hundred pounds and that in twenty pounds gold, that is to say that forty pounds shall be paid in the whole in one year, the beginning thereof to be made in one year after my son Samuel shall come to the age of twenty one years which said one thousand pounds shall be equally divided between my said wife Mary and my two daughters in manner following the first forty pounds to be paid to my said wife and the second to my daughter Mary now the wife of Samuel Throne and the third to my daughter Elisabeth now the wife of Michael Bucher and then again to my wife and so on in manner aforesaid till paid according to the meaning aforesaid and all the said one thousand pounds to be paid in hard money gold or silver whereupon my two sons namely Christian Kehr and Samuel Kehr shall have and hold all my said lands and plantation with the appurtenances thereto belonging to them their heirs and assigns for ever, and in case they could not agree and live together in peace and should want the lands divided my will is that it shall be divided with a cross line between the upper part and the lower part and that as equall as it can be esteemed and then my son Christian shall have the upper part for his share adjoining the lands of Samuel Havnish and my son Samuel shall have the lower part adjoining the lands of Adam Eichelberger deceased, for his share and each of them shall pay the sum of five hundred pounds for his share in manner aforesaid; and if they or either one of them should want a deed for his part of land I intitled my executors hereafter named to execute a deed or deeds of conveyance to each of them according to law and to the meaning aforesaid only excepting an equal right and privledge for the lower part, to have the conveniency of the water to water the meadows in an as full a right as the upper part and if the land should be divided then my son Christian shall have the use of the young orchard in manner aforesaid for the space of ten years after my son Samuel shall be of age, and in case my son Samuel should die without leaving any issue then my son Christian shall have the whole of the place for the sum aforesaid and to be paid in manner aforesaid. And lastly, I do hereto appoint and nominate my loving brother in law Henry Danner and my trusty friend Samuel Flickinger to be the executors of this my last will and testament hereby revoking all former wills by me made publishing and declaring this and no other to be my last will and testament.

In witness whereof I have hereunto set my hand and seal this twenteeth day of November, in the year of our Lord One Thousand Seven Hundred and Ninety Three.

Before me Jacob Barnitz Esq. register for the probate of wills and granting letters of adminiatration in & for the County of York in the state of Pennsylvania, personally came Michael Eichellinger, Samuel Eichellinger and Samuel Becktel, the three subscribing witnesses to the foregoing instrument of writing and they the said Michael Eichellinger and Samuel Eichellinger on their solem oath and the said Samuel Bechtel on his solem affirmation (he contentiously scrupling the taking of an oath,) do severally say that they were personally present and saw and heard the above named John Kehr sign his name unto and seal and publish the foregoing instrument of writing as and for his last will and testament and at the time of the doing thereof he the said John Kehr was of a sound and disposing mind memory and understanding to the best of their knowledge and belief; and that they respectivly subscribed their names as witness in the presence of the said testator and at his request and also in the presence of each other at the same time. Sworn, affirmed & subscribed before me, at York the eighth day of March AD 1794.

A true copy taken from and compared with the original at York Jab Barnitz Esq. Memorandum that letters testamentary in common form were granted unto Henry Danner one of the executors of the estate of John Kehr, deceased. Inventory to be exhibited into the registers office at York on or before the eighth day of April next and an account or reconing in a year or when legally thereunto required. Given under my hand & seal of office at York the eighth day of March A.D. 1794. Jab Barnitz, Esq.
